It’s Time to Take Action!
In less than two months, the World Health Organization (WHO) will gather in Geneva for the 77th annual World Health Assembly. Members of the WHO, including 194 nations, will vote on two agreements that threaten national sovereignty and our personal health freedoms. These documents, the Pandemic Accord (Treaty) and the amendments to the International Health Regulations (IHR) will give the WHO’s Director General, Tedros Ghebreyesus, unprecedented power to declare whatever he deems to be actual or potential “public health emergencies of international concern” and dictate what must be done in response.
Despite our best efforts to get Congress to defund the WHO in the last appropriations bill, the language defunding the WHO and requiring Senate ratification of these documents was removed in the final bill. Because the World Health Assembly is to meet at the end of May, the time is NOW to take every action to stop or delay the meeting, require the Senate to ratify these international agreements, and encourage our state governments to stand up and reassert their 10th amendment rights.

The Senate must demand that the President submit the WHO’s Pandemic Treaty and the IHR amendments to the Senate for its “advice and consent” before the Administration agrees to them. Art. 2 Section 2 of the Constitution gives the power to make treaties to the President, “by and with the advice and consent of the Senate.” Too often, as is being done with these WHO documents, the President can bypass the Senate by unilaterally declaring internationally negotiated accords to be “executive agreements” that are not mentioned in the Constitution and are not submitted to the Senate for advice and consent.
According to a study by the Senate Foreign Relations Committee in 2001, “The requirement for the Senate’s advice and consent gives the Senate a check over all international agreements submitted to it as treaties. The main threat of erosion of the Senate treaty power comes not from the international agreements that are submitted as treaties, however, but from the many international agreements that are not submitted for its consent.”
The Senate MUST assert its authority and be allowed to give its advice and consent. Several bills have been introduced that will ensure this happens, including S. 444, the No WHO Pandemic Preparedness Treaty Without Senate Approval Act.

State legislatures have entered the battle by introducing legislation to clarify that the WHO will have no power to tell them what to do.
On March 26, the Louisiana state Senate unanimously passed a bill that states, “No rule, regulation, fee, tax, policy, or mandate of any kind of the World Health Organization, United Nations, and the World Economic Forum shall be enforced or implemented by the state of Louisiana or any agency, department, board, commission, political subdivision, governmental entity of the state, parish, municipality, or any other political entity.” It is expected to pass the state House and be signed by the Governor soon.
Alabama and Tennessee have also introduced similar bills to restrict the reach of the WHO. Encourage your state legislature, governor, or even city government to enact resolutions or statements in opposition to the WHO global takeover of public health.

As the World Health Organization (WHO) rushes to put the finishing touches on amendments to the International Health Regulations (IHR) and the Pandemic Preparedness Agreement (i.e., “treaty”), it is important to remember the goal of the WHO is not to facilitate coordinated reactions to public health emergencies but to dictate the world’s response to “all risks that have the potential to affect public health” including non-medical risks like food choices, biodiversity, gun violence, and climate change.
Despite their protestations to the contrary, the amendment to the International Health Regulations and the Pandemic Preparedness Treaty are threats to not only our national sovereignty but to personal sovereignty as well.

The Senate immigration language dropped Sunday night, and it’s even worse than we thought. Despite promises from Senate drafters of mitigating the border crisis, the bill puts into law the very problems that caused millions of illegal aliens to cross our borders. Our hope was that this legislation would have forced the Administration to act to protect the nation, but instead, the bill allows them to continue the actions that have led to the problems we see in every major US city. After reviewing the text, here are some of the policies:
The Secretary of Homeland Security does not have to act until 5,000 border encounters are reached daily for 7 days. Allowing thousands of illegals into our country every day is unacceptable.
There is no provision that “shuts down” the border. Even if the President declares a national emergency, the Secretary of Homeland Security must allow 1,400 immigrants to enter per day.
The President can avoid taking action to limit the number of illegals entering by saying it’s in the “nation’s best interest” to keep the border wide open.
Unaccompanied minors are exempt from all removal provisions and will not be counted as part of the daily numbers unless they are from Mexico. They will each be assigned a taxpayer-funded lawyer.
Work visas will be immediately provided for asylum seekers.
Expulsion authority sunsets in 3 years.
Allocates $1.4 million to non-governmental organizations (NGOs) to provide services to illegals.
Puts the D.C. District Court (a very left-wing court) in charge of any challenges to the law instead of the 5th Circuit Court which has jurisdiction over Texas.
Codifies catch-and-release and parole programs that allow asylum seekers to disperse throughout the country.
Does not include “remain in Mexico” (that mandates asylum seekers remain in Mexico until their status hearing).
The President has the authority under current law to shut down the border. In fact, the U.S. House of Representatives is bringing up articles of impeachment for Homeland Security Secretary Alejandro Mayorkas because of his refusal to enforce basic border security laws. In a tweet in support of the bill, Senator Chris Murphy (D-CT) made clear,” The border never closes, but claims must be processed at the ports.”
Senate Majority Leader Chuck Schumer (D-N.Y.) has announced a vote on this bill on Wednesday which only gives Senators and the American people three days to read and understand this complex 400-page bill. Rushing a vote on a bill of this magnitude in such a short amount of time guarantees that the details will be overlooked. IF a vote must take place on this bill, it needs more time for debate and education.

Eagle Forum Applauds Withdrawl of NAC rule by SEC
Eagle Forum President Kristen A. Ullman released the following statement in response to the Securities and Exchange Commission Notice of Withdrawal of Proposed Rule Change for Natural Asset Companies:
Americans across the country who believe in property rights and understand that the natural assets of our great land should not be for sale to the highest bidder, including foreign sovereign wealth funds, are grateful that the SEC has withdrawn this proposed rule today.
Thousands of concerned citizens submitted comments to the SEC expressing their opposition to the approval of these new investment vehicles. The purpose of NACs, according to their creators, would be to “hold the rights to the ecological performance (i.e., the value of natural assets and production of ecosystem services) produced by natural or working areas, such as national reserves or large-scale farmlands, and have the authority to manage the areas for conservation, restoration, or sustainable management.”
In other words, this means that NAC could license the rights to manage both public and private lands as long as they do not conduct any ‘unsustainable activities’, such as mining, farming, drilling, or grazing that lead to the degradation of the ecosystems. If approved, the NACs would hurt the United States’ ability to not only enjoy public lands like our fantastic National Parks but would potentially hurt our ability to be energy-independent and harm our domestic food supply.
Not only would NACs cause economic harm, but they open the door to serious national security implications. Russian, Chinese, or Saudi sovereign wealth funds would have been allowed to invest in NACs. Their interest would have been to hurt our food and energy security and lock up U.S. natural resources.
Eagle Forum is delighted that the SEC withdrew the Proposed Rule today. Our message to the SEC, the NYSE, and the Intrinsic Exchange Group (IEG), the private company that “advises public sector and private landowners on the creation of NAC structures and strategies,” is that the right to manage America’s lands — as well as our waterways and even the air we breathe — is not for sale. Not to businesses and foreign countries seeking to profit from the “sustainability” racket by locking up public and private lands from productive use. We are committed to protecting not only our property rights but our nation’s ability to use our lands to provide food, energy, and recreation to all Americans.

This week, the U.S. House of Representatives will vote on legislation to nullify a rule that allows China to manufacture electric vehicle (EV) chargers.
S.J. Res. 38 uses the Congressional Review Act to reign in the powers of bureaucrats who try to use the power of the pen to rewrite existing law. Our Representatives are taking action to protect American manufacturing through this process.
The Trump Administration put America first by creating policies that move American businesses away from China and prioritizing American products. When Joe Biden saw that the American people wanted this, he rode President Trump’s coattails and introduced his “Buy American” campaign plan. Some of these policies were placed into the 2021 infrastructure bill, including requiring EV chargers to be made mostly of American-made materials. Now, he’s clawing those provisions back.
Last year, the Federal Highway Administration obtained a waiver to allow other countries — mostly China — to once again have a monopoly on EV materials production. This would violate existing federal law and allow Communist China to continue to dominate this sector.
Even in a Democrat-controlled Senate, this measure passed in November. If the House passes S.J. Res. 38, it will go straight to the President’s desk. This bipartisan exercise would hold the Biden administration accountable for their unlawful practices.
We ask that you contact your Representative to ask for a vote in favor of S.J. Res. 38, the resolution to disapprove of the Federal Highway Administration’s waiver on electric vehicle chargers.

The U.S. House of Representatives is voting this week to save our choice of cars!
The Environmental Protection Agency (EPA) is aggressively attempting to restrict the choice to purchase gas-powered cars. Instead, they are trying to mandate electric vehicles to take over the automobile industry. Known as the “toughest-ever” restriction on car emissions, the EPA’s new standards would prohibit over 82 grams of CO2 per mile, which is a 56% reduction from the original 2026 standards. To meet these requirements, automobile manufacturers must replace 67% of their fleet of traditional vehicles with electric vehicles by 2032. Electric vehicles are, on average, $17,000 more expensive than their gas-powered counterparts. To make matters worse, the federal government granted a waiver to the state of California giving them the ability to ban all internal combustion engine vehicles and allowing other states to be covered by that waiver. California’s liberal policies do not belong in all other states.
Representative Tim Walberg’s (R-MI) Choice in Automobile Retail Sales “CARS” Act (H.R. 4468) prohibits these standards from being implemented. Not only are these standards dangerous to our pocketbooks and the U.S. automobile industry, but they will benefit China’s domination of the supply chain in the EV market. This is also an egregious infringement by the federal government on consumer freedom. The EPA should not have this much control over our personal choices. This is why Rep. Walberg’s bill is so important and needed.

When lawmakers left town for the Thanksgiving holiday, the Texas House had removed Education Savings Accounts from HB 1, their Education & School Choice bill. Governor Abbott has said he will continue calling special sessions until School Choice passes.

HB 1, which includes the education savings account program, was considered in the House Calendars Committee yesterday and placed on the General State Calendar today.
HB 1 - Relating to primary and secondary education, including the certification, compensation, and health coverage of certain public school employees, the public school finance system, special education in public schools, the establishment of an education savings account program, measures to support the education of public school students that include certain educational grant programs, reading instruction, and early childhood education, the provision of virtual education, and public school accountability.

The House passed the wall construction bill SB 3 with the amendment to provide support to local law enforcement agencies with funding. The bill also provides for $40 million for TDPS to police Colony Ridge, providing monetary support to SB 4. The amended bill now goes to the Senate for approval.
The House also passed SB 4 without amendment, though not for lack of trying. Twenty-four (24) amendments were attempted on the house floor, all failing, thankfully as Jared Patterson (HD 106, R) motioned to end debate, which passed. This bill provides for criminal penalties for illegally entry and presence in the state.
The House adjourned until Friday.

It looks like we are breaking through on a good border bill that will not only criminalize the act of an alien crossing the border outside a port of entry inSB 4to Texas, but will allow removal after due process of that alien after collection of biometric data in lieu of a criminal conviction.
SB 4 has already passed the Senate and has passed unamended out of House State Affairs, headed to the House floor (if quorum can be obtained, but that is another story).
The backstory on this is HUGE. Especially to this group that understands that in the current situation of deliberate lawbreaking by a stolen, corrupt federal government that is endangering and killing Texans, a state sovereignty mindset is vital.
The problem has been that Senator Birdwell does NOT have a state sovereignty mindset. He is a federal supremacist, deferring the security of Texans to the very feds that are deliberately endangering us. Birdwell is an honorable man and committed to honor his oath to the Constitution as his independent judgement dictates.
The problem is that Birdwell is DEAD WRONG in his interpretation of the U.S. Constitution on this issue. And because he had been appointed the lead in the Senate on border security by Lieutenant Governor Dan Patrick, he has been stopping the legislature from passing legislation that will actually defend Texans from the collusion between the feds and the cartels that endangers us all.
The news here is that Birdwell's fellow Republican Senators behind the scenes persuaded Dan Patrick that Birdwell had it wrong and to turn over the bill for this session to Senator Charles Perry, so that an effective bill could be passed.
Attorney General Ken Paxton appeared as an invited witness in front of Birdwell's Border Security Committee at the beginning of the regular session early this year. In that presentation, Paxton told Birdwell that US v Arizona was wrongly decided and that he predicted that given the facts of today and the current composition of the court, that SCOTUS opinion could be overturned. US v Arizona has been viewed as saying that the federal government has complete control over "immigration" issues and that states are powerless when the feds either do not do their duty, or worse as is the case now, deliberately destroy the security of Texas.
I told Senator Birdwell later in that hearing that the U.S. Constitution reserves the natural right of self-defense to Texas in the final exception clause of Article I, Sec. 10. It is a pre-Tenth Amendment reservation of power to Texas that Texas gets to decide when and how to implement without second guessing or permission from the federal judiciary. But he could not hear or accept that.
The fact is that We the People of Texas are the bosses. Through our state government and the U.S. Constitution, we are the masters of the feds, delegating a few defined powers to them. We did not Constitutionally and should not turn over our security and surrender our sovereignty to a corrupt, stolen federal government when it "evinces a design to reduce [us] under absolute Despotism."
I salute Lieutenant Governor Dan Patrick and the other members of the Senate for holding firm to THEIR interpretation of the Constitution on this matter!
Senator Birdwell voted with the Democrats in the Senate against SB 4. But every other Republican Senator who was there voted for it to pass it.

The 4th Special Session will be focused on Education and Border Security.
Governor Abbott Announces Special Session #4
The third special session ended this afternoon with the House and Senate immediately beginning the fourth called session.
Governor Abbott’s third special session agenda called for bills addressing education, border security, the Colony Ridge illegals development, and prohibiting COVID vaccine mandates by private employers.
Only two bills passed in the third special session:
SB 7 by Senator Mayes Middleton will prohibit employers from requiring COVID vaccines for employees as a condition of employment.
SB 4 by Senator Pete Flores will increase penalties for human smuggling and operating a stash house, establishing a mandatory minimum sentence of 10 years for violations.
Other bills regarding border security, Colony Ridge and Governor Greg Abbott’s priority, School Choice legislation, died in the House.
The fourth special session begins this evening, focused on education and border security.
A draft of a new School Choice bill, this time from the House, has already been placed on the table for consideration in the fourth special session.
The bill, HB 1 by Representative Brad Buckley, would set up Education Savings Accounts, but would additionally include teacher pay raises and additional monies for school districts. As currently written, each qualified child would be allocated $10,500 for private school tuition and expenses and home schooled children would qualify for $1,000 a year toward expenses.
The business of testing students would be a beneficiary under this plan, as each student that receives an ESA would be required to take a state assessment or a nationally norm-reference test. Student testing is big business and all sorts of government-required learning can be wrapped up into them.

Please be sure to vote on November 7! This election will determine amendments to the Texas Constitution, including Proposition 4 to lower property taxes. Many voters decide not to participate, then wonder why laws have changed or have been added that they may not be in favor of.

The Texas Senate just passed SB 6 out of the Finance Committee, which provides $1.54 billion to build the wall and add law enforcement to Colony Ridge.
Today's court ruling sends a strong message to the Biden administration: If Biden won't secure the border, Texas will, and the courts will back us up.

The Texas House has passed border security funding, increased criminal penalties for human smuggling, and criminal penalties for improper entry from a foreign nation.
Border Security Funding
House Bill 6 appropriates $1.5 billion in funding for constructing, operating, and maintaining border barrier infrastructure.
Funds in HB 6 will be used to prioritize the most at-risk areas of the border as determined by the Texas Department of Public Safety.
The bill was amended to ban the funds from being used for eminent domain of private land or to build a barrier along Texas’ borders with other U.S. states. The amendment passed by a vote of 134-4.
An amendment was proposed by Democrat State Rep. Jessica Gonzalez to ban the funding from being used for buoy barriers in the Rio Grande, but it failed.
The bill passed in a vote of 84-61 and will move to the Texas Senate.
Human Smuggling
Senate Bill 4 will increase penalties for human smuggling and operating a stash house. It establishes a mandatory minimum sentence of 10 years for violations of SB 4.
Although several amendments were proposed by Democrats, all failed to pass.
The final vote was 92-54. SB 4 will now be sent to the governor’s desk.
Illegal Entry
To create a criminal penalty for improper entry into Texas from a foreign nation, the Senate and House have each passed their own bills: Senate Bill 11 and House Bill 4.
HB 4 passed the Texas House by a vote of 84-60. It now goes to the Senate for consideration.
The third special session expires on November 7.

We have a new, conservative, Christian U.S. House Speaker, Mike Johnson (R-LA). He is a constitutional lawyer and has been a conservative talk show host. He drafted a document describing the seven core principles of conservatism in which he believes:
Individual freedom
Limited government
Rule of law
Peace through strength
Fiscal responsibility
Free markets
Human dignity
These principles are considered extreme these days by the left.
What about Austin?
Now…what about the Texas Speaker? Never underestimate the power of momentum. The combined events behind the selection of a conservative U.S. Speaker and the failed impeachment trial of AG Ken Paxton got the ball rolling.
What Kevin McCarthy did to earn a motion to vacate pales in comparison to the activities of Dade Phelan in his role as Texas Speaker of the House.
We are currently watching as our legislature takes a third special session to try to get anything meaningful past the gauntlet created by a coalition of Democrats and RINOs, reigned over by Speaker Phelan. Until that situation changes, the only thing that will change in Texas is that Texas will gradually fade to blue.
The most important call you may make in this session is to call your legislator and insist that someone move to vacate the chair. And if it is shot down, try again and again and again. Where there is change, there is hope. We just saw it in D.C.

Contact your Texas House Representative and demand he vote to vacate the chair and remove Rep. Dade Phelan as Speaker.

Senate Bill 7 - “Prohibiting a private employer from adopting or enforcing certain COVID-19 vaccine mandates; authorizing an administrative penalty.
The legislation was placed on the agenda of the third special session by Governor Greg Abbott earlier this month and quickly passed by the Senate.
According to Texas Scorecard:
“An amendment by State Rep. Brian Harrison (R–Midlothian) to broaden the bill to include any person, rather than just employers, was struck down by Speaker Dade Phelan on a point of order on the grounds that it was not germane to the governor’s call—which solely mentioned employers. Another amendment by Harrison to explicitly expand the protection to medical school students in light of Baylor College of Medicine’s mandate was also struck down by Phelan on the same grounds.
“State Rep. Briscoe Cain (R–Deer Park) then successfully added an amendment that expanded the definition of “contractor” to include anyone “who undertakes specific work for an employer in exchange for a benefit without submitting to the control of the employer over the manner, methods, or details of the work.” Cain said this provision could work as a creative means to protect medical school students within the governor’s call.
“One of the biggest moments in the debate, however, happened when State Rep. Steve Toth (R–The Woodlands) brought forth an amendment to increase the fine to $50,000. Leach called the amendment “reckless and silly” and stated that Sen. Middleton and the Senate would oppose raising the fine, putting the legislation in jeopardy.
“Harrison, however, said he had spoken with Middleton about the exact amendment and that he had expressed support for it.
“The House then adopted the amendment 87-57.
“State Rep. Tony Tinderholt (R–Arlington) also attempted to amend the legislation, to require employers to rehire or compensate employees that are fired because of their refusal to get the vaccine. That amendment was killed by Phelan on a point of order.
“House lawmakers approved the legislation in a vote of 90-57.
“The bill must now receive another vote before being sent back to the Senate. They can approve the changes made in the House or send it to a conference committee to hammer out a compromise.”

Congressman Mike Johnson (R-LA) was elected as the U.S. Speaker of the House today. As a Congressman, Speaker Johnson represents the northwest and western regions of Louisiana. Prior to his election to Congress in 2016, Speaker Johnson was an attorney and served in the Louisiana State Legislature from 2015 to 2017.
The first thing Speaker Johnson did upon winning the Republican Conference vote yesterday evening was to lead a prayer with the Conference.
The vote for Speaker was held at noon today. Rep. Johnson reached the 217 mark necessary to become the new U.S. Speaker and was elected unanimously by the Republican Conference.
Speaker Johnson made this statement upon his election:
“It is the honor of a lifetime to have been elected the 56th Speaker of the House.
“As Speaker, I will ensure the House delivers results and inspires change for the American people. We will restore trust in this body. We will advance a comprehensive conservative policy agenda, combat the harmful policies of the Biden Administration, and support our allies abroad. And we will restore sanity to a government desperately in need of it. Let’s get back to work.”
Democrats and leftists immediately took to social media slamming Speaker Johnson for his support of the 2020 Election investigation, his support of President Trump, and his strong conservative stance on issues.
Two hours before his election this morning, he posted “In God We Trust” on his social media.

HB 4 by Representative David Spiller of District 68, would give Texas a vehicle for removing illegal aliens from our state.

The Biden administration is bullying schools out of their lunch money. For over a year, public schools have had no choice but to allow boys in girls' restrooms or lose their funding for school lunches. Democrats are effectively stealing children’s lunches to get their way.
In May 2022, the U.S. Department of Agriculture (USDA) weaponized Title IX’s prohibition on sex discrimination to make public schools comply with their radical LGBT agenda. After redefining “sex” to include gender ideology, they have tried eliminating all privacy rights for girls and women.
The USDA’s Food and Nutrition Services claims its mission is to “reduce hunger” and “provide children and low-income people access to food.” Yet they are willing to deny food to the vulnerable in states and schools that choose not to advance their radical agenda.
Under the Congressional Review Act, Congress can reject Executive Branch rulemaking as part of their Constitutional duty of checks and balances. Senator Roger Marshall (R-KS) is using this tool to advance a resolution for Congressional disapproval of this guidance (S.J.Res. 42). Also, 22 state attorneys General have sued the Department of Agriculture over this proposed rule.
Sen. Marshall explained his legislation in a press release saying:
The USDA has NO authority to force our children to adhere to woke mandates such as requiring biological boys to be given access to girls' bathrooms and locker rooms, or allow biological boys to compete against biological girls in girls' sports. My message with this CRA is clear: Don’t hold children’s lunch hostage in pursuit of your woke agenda.

I am writing to express my deep concern about the rising security threats to our Texas Power Grid. Vandalism and sabotage have increased by 1900% since 2017, with 19 reported events in the first six months of 2023 alone.
Utility companies have blocked efforts to establish minimum security standards, and there is a shortage of transformers worldwide. Coordinated attacks on large substations have occurred, and individuals from foreign adversaries are entering through the unsecured border.
I urge you to address this emergency promptly in two ways:
1) Add legislation in a special session to direct and fund the hardening of electrical transmission and generation facilities and other critical infrastructures against the threat of solar disturbances, nuclear electromagnetic pulse (EMP) attacks, foreign and domestic terrorists, and to provide measurable resiliency to critical infrastructure against all-hazards in Texas.

Twenty-one votes, or two-thirds of the Senate, were required to convict and remove Paxton from office on any single charge. None of the charges received a majority vote. It became abundantly clear during the trial that the move was political as the House prosecution team was unable to present evidence of the claims against AG Paxton. What DID become clear is that we need a good house-cleaning in the Texas House. AG Paxton now is cleared to return to office to fight on behalf of Texans. Once again, the Biden administration has found another loophole to push their abortion agenda. The Equal Employment Opportunity Commission (EEOC) is issuing a new rule that forces nearly all businesses to provide leave for their employees to obtain abortions. We must let the EEOC know that we are disgusted with their course of action.
Last year, the Pregnant Workers Fairness Act (H.R. 1065) passed into law. This bill required all businesses with over fifteen employees to provide maternity leave for pregnant women. The responsibility to implement this policy fell on the EEOC, but they instead warped the language to fit their own agenda.
Now, the EEOC wants to force businesses to provide "maternity" leave for women obtaining abortions. While they provided a religious exemption for religious organizations, the language is very narrow and includes a caveat that the EEOC will handle these on a case-by-case basis. Seeing that the Biden administration has targeted religious and conservative organizations for their differences in opinion, we cannot trust them to be fair in issuing those exemptions.
This rule does not protect non-religious businesses. Bakery owners, boutique stores, and floral shops are just examples of industries that will be forced to provide abortion accommodations on their dime should the situation arise. If they refuse, they could be prosecuted by the federal government in expensive litigation that could take years.
You can make your voice heard on the new EEOC regulation forcing employers to cover time off for abortions by submitting a comment. We have provided you with a sample comment, but recommend you edit the language in your own words. If the comment differs from others, the EEOC must read and respond to each individual's comment. Submit your comments before October 10th to let them know that you oppose this regulation.

As an American citizen, I am concerned about the Equal Employment Opportunity Commission’s implementation of the Pregnant Workers Fairness Act. I believe that pregnant mothers and their babies deserve the utmost care and support. However, the EEOC has warped the language to include leave for women seeking abortions.
Under this language, business owners will be put in a terrible position. This leaves the door open for owners to encourage women to obtain abortions so they can keep their employees in their positions. On the other hand, if an owner has moral or religious beliefs opposing abortion, they are still forced by federal law to provide this accommodation. While the rule allows a religious exemption, it is narrowly written for the most explicit religious organizations and is still subject to scrutiny on a case-by-case basis. This does not protect business owners who sincerely oppose abortion.

Biden has proposed new environmental regulations on nearly every vehicle including passenger cars, pick-up trucks, vans, SUVs, etc., that will push the automobile industry beyond the breaking point and keep you from purchasing a gas-powered vehicle after 2032.
Under Biden’s direction, the Environmental Protection Agency (EPA) has issued new regulations that would squeeze gas powered and even hybrid cars out of the market by imposing strict carbon emission standards.
If enacted, this regulation will require automobile manufacturers to cut carbon emissions on “light-duty vehicles” (cars, pickups, vans, SUVs) by 56% of current levels by model year 2032.
This would require an increase in the sales of electric-vehicles (EVs) to offset the carbon emissions of gas powered vehicles in order to achieve an overall net carbon emission reduction. Currently, EVs make up only 6% of new vehicle purchases. In just 9 years, Biden is looking to use the heavy hand of the government to grow EV sales to make up 67% of all vehicles purchased.

By law the agency must accept public comments on its proposed regulation. All unique and substantive arguments submitted must receive a written response from the administration before the regulation can be put into place. Personalizing the comment you submit will make it more impactful. So please share how Biden’s gas car ban would hurt you and your family.
Comments can force the agency to grapple with conservative arguments they would otherwise like to ignore. And comments can be used against the regulation in a court of law - leading to it being struck down. Do not underestimate how influential your comment can be.

The U.S. House of Representatives passed the Fiscal (Irresponsibility) Responsibility Act in a 314 to 117 vote on Wednesday evening. The Resolution will advance to the Senate ahead of the June 5 deadline with a vote expected as early as Thurs., June 1.
The vote in the U.S. House on Wednesday evening clearly separates UniParty representatives from fiscally conservative patriots - 149 Republicans voted “Yes” while 71 Republicans stood with “We the People” and voted “No.” To see if your Representative voted with the UniParty group think, click here.
Democratic Senate Majority Leader Chuck Schumer called the House vote “very good,” telling reporters that “we hope we can move the bill quickly here in the Senate as soon as possible.” We must thwart the passage of this irresponsible bill!

The last two weeks of the 88th Legislative Session were historic but for all the wrong reasons. On Friday, May 19, an allegedly intoxicated Speaker Dale Phelan presided over the House which prompted Texas Attorney General Ken Paxton to call for Speaker Phelan to resign.
A few days later in what seemed to many like an act of retribution, Speaker Phelan announced that the House would be moving forward with an impeachment process against Attorney General Paxton.
Then in the waning hours of the 88th Legislative Session of the Texas House, Speaker Phelan revealed that there had been a months-long investigation into alleged misconduct of Texas Attorney General Paxton for offenses that were said to have occurred in 2020.
According to Speaker Phelan, the investigation began when the House was asked to approve taxpayer funds in the amount of $3.3 million to be paid in a settlement to whistleblowers who made accusations against Attorney General Paxton dating back to 2020. That case is still pending before the Texas Supreme Court. The settlement offer does not include any admission of wrongdoing and the courts have not ruled on the matter. No settlement payments have been made related to this case.
Many members of the Texas House were obviously caught off guard when the investigation was revealed by Speaker Phelan. Then just three days after the revelation of this investigation, the members of the House were asked to vote on whether the 20-charge indictment presented to the House was sufficient to impeach Attorney General Paxton and move the case to the Texas Senate for a formal trial which could result in removing Paxton from office.
Prior to the vote, House members were not permitted to talk to any witnesses or even to any of the investigators who interviewed witnesses. Instead, the 20 articles of impeachment were read on the House floor and a vote was called shortly thereafter on the same day.
Rep. Steve Toth from Montgomery County said during the House debate, “I am not commenting on Mr. Paxton’s guilt or innocence, rather the lack of credible process that has gone on today… By moving forward without proper guardrails on the initial removal of a statewide official sets Texas on a dangerous path. I ask you to tap the brakes. Let’s make sure we do this the right way and not the wrong way. Please vote no.”
It was certainly predictable that 60 Democrat House Members would vote to impeach Paxton since he has been a staunch conservative who has been effectively fighting, and winning, against the Biden Administration for the last few years. But when 60 Republican House Reps joined the Democrats in that hasty vote, it was shocking to many.
As a result of the impeachment vote, by rule, Paxton was suspended from his duties and Governor Abbott has since appointed former Secretary of State John Scott as interim Attorney General.
After receiving the Articles of Impeachment, Lt. Governor Dan Patrick set in motion the Senate’s duties by creating a “Special Committee to Recommend Rules and Procedures” to establish the rules for the impeachment hearing, after which a date will be set to begin the proceedings. Senator Brandon Creighton (SD 4) from Montgomery County is one of the seven members of the committee.
There is no doubt that Attorney General Paxton is highly effective in his job. He has been a true warrior against Human Trafficking and has taken on “Big Pharma.” He has also won major cases for Texas in the areas of Immigration, School Rights, EPA Rules and Religious Freedom.

Governor Greg Abbott today appointed John Scott as the short-term interim Attorney General of Texas, under Article 15, Section 5 of the Texas Constitution.
Scott most recently served as Texas Secretary of State for Governor Abbott. Why does our Texas Speaker of the House seem to be at war with efforts to pass measures to secure our border? A Grassroots America report states, “Let it sink in that we are about to end this session with ZERO RESULTS on the part of the Texas Legislature to stop the planned destruction of Texas and the US with a wide-open border flooded by millions of illegals!”
HB 20, the most significant legislation in our GOP efforts to protect citizens from the flow of cartels, drugs, and criminals that inevitably flow across an open border was victim of an unnatural death. Although the Speaker claimed it as a priority bill, he allowed a Point of Order procedure from opponents to send it back to committee, where it died.
Proponents of border security (you would think there would be plenty) are trying to graft important elements of HB 20 onto another border bill, HB 7, to try to save the effort.
The Senate must amend HB 7 to:
Add the authorization ‘to repel’ to the Border Force created by the legislation, and
Give the governor backing for the legislature to take independent action to protect Texans from cartels.
Talk in Austin suggests that the same treatment HB 20 received on the House floor is likely for the amended HB 7 when it gets to the Senate floor. Your outrage may be the only thing that stands in the gap.

Part 1 by Tom Glass, Texas Constitutional Enforcement & Texas Conservative Grassroots Coalition Leader
On Thursday, Texas Senate Border Security Chair Brian Birdwell unveiled his substantive committee substitute for the only remaining border security vehicle for the session, State Rep. Ryan Guillen’s Speaker-designated HB 7.
Chair Birdwell added back a slightly different version of the border trespass felony and for the most part de-emasculated, but he left out the most important mission for the unit – to repel illegals crossing between legal ports of entry!
The unit was moved to be part of the Texas Rangers, reporting to the head of the Texas Rangers, up through the directors of the DPS, which reports to the governor. The county veto and jurisdictional limits in HB 7, which we opposed, were removed.
The vital thing to know is that the Texas Constitution in Article 4, Section 7 authorizes the governor to repel using the Texas military when invaded. But law enforcement, as this new Border Force will be designated, must have statutory authorization to repel. If we don’t add repel to HB 7, the governor will not have legal authority to use the Texas Border Force to repel and will have to rely on the Texas military to do it.
And, sadly, all legislative findings setting us up with the best constitutional arguments when we are dragged into federal court, are completely missing from the bill. Significantly, a MALDEF attorney testified at the hearing (as she had in House State Affairs), that MALDEF considered any action Texas takes to secure the border to be immigration enforcement and therefore preempted by US v Arizona.
It is vital that our border security bills have legislative findings making clear that Texas is NOT enforcing immigration law, but rather acting under the self-defense reservation of power of Article I, Section 10 when we are in imminent danger or actually invaded.
Solution to the glaring deficits of HB 7:
JoAnn’s NOTE: Without the two amendments Tom has recommended below, HB 7 is a disaster! Let it sink in that we are about to end this session with ZERO RESULTS on the part of the Texas Legislature to stop the planned destruction of Texas and the US with a wide-open border flooded by millions of illegals! These two solution amendments by Tom Glass are our last hope to salvage something!
Lt. Gov. Dan Patrick and Republican State Senators must amend HB 7 with language to accomplish these two necessities:
1) add the authorization “to repel” to the Border Force and
2) add legislative findings giving the governor backing from the legislature to take independent action to protect the people of Texas from the cartels.

The heroic Matt Schaefer, who worked on the Speaker’s border priority bill (HB 20) that the Speaker himself killed, predicts that a point-of-order similar to what killed HB 20 will be used to kill HB 7 when it gets back to the House. I have told him that the Speaker will get most of the blame for the failure of his own two border security jewels if the point of order does indeed do as Schaefer predicts. And everyone I have talked to thinks it likely that if HB 7 is killed by the Speaker, that the governor will add border security to the call of the special session that we all know is coming for other reasons.
Note that the border interstate compact SB 1403 by Tan Parker and David Spiller has been sent to the governor!

SB 8: (Creighton, et al) – OPPOSE - The House Committee on Public Education will hear SB 8 on Monday. This is a 50-page bill – the first 50 pages are about assessments – and it attaches them to the FEDERAL GOVERNMENT!
“Sec. 39.0221. TRANSITION TO TEXAS SUCCESS INITIATIVE ASSESSMENT. (a) As soon as practicable and not later than the 2027-2028 school year, the agency shall: (1) adopt or develop assessment instruments in accordance with Sections 39.023 and 39.0236 as those sections were amended by __.B. ___, Acts of the 88th Legislature, Regular Session, 2023; (2) submit the assessment instruments described by Subdivision (1) for federal approval; and (3) transition from the State of Texas Assessment of Academic Readiness (STAAR) assessment instrument and implement the assessment instruments described by Subdivision (1).”
Based on this language TEF cannot find a way to support this bill. Why would we pass a law that creates a new relationship to the federal government? The federal Dept. of Education is not even constitutional and yet we are acknowledging it in a bill? It also mentions “homeschool” which the previous bills have been careful not to do – for good cause and caution.
I know some of you have been very excited about school choice money for your children or grandchildren (and others very opposed). We have read each bill and find they almost all had too many strings attached and several were prejudiced against those who were already sacrificing to be at private schools. We hoped for a bill that would allow a parent to use a credit equal to their ISD property taxes and sales taxes to help fund a child’s educational expenses. Renters could claim the portion of their rent that paid the owner's property taxes. No such bill even got a hearing.

SB 14 Update: 18 states have already banned “gender transitioning” for minor children. Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kentucky, Mississippi, Missouri, Montana, North Dakota, Oklahoma, South Dakota, Tennessee, Utah, and West Virginia are all ahead of Texas in doing the right thing for our children.
SB 14 – SUPPORT - Protecting children from bodily mutilation and sterilization was scheduled for a house floor vote on Tuesday, May 2, and again on Friday, May 5. It was held up by points of order on both days. On Friday, three points of order were called by House Democrats. All three POOs were withdrawn but one stuck. Nitpicking a bill to death seems to have become a game. They usually go after things that have absolutely no relevance to the bill. Both days, Public Health Committee Chair Stephanie Klick (Republican) has moved to recommit SB 14 back to her committee. The House Calendars Committee just scheduled SB 14 for Friday, May 12.

OTHER ISSUES
One of the best helps we can give our public education students is a parental opt-in for assessments. These would include surveys on their sexual activity (These introduce and normalize ideas like anal sex to young students without informing parents first!) and assessments on how they feel, what is in their head, if they are hungry, what is their anger level, etc. This data is kept, some schools call CPS if a child is sad or hungry 3 days in a row. Children should not start their day by focusing on their feelings.
SB 595 SUPPORT or HB 1149 SUPPORT - parents can protect their children from these invasive and sometimes indoctrinating activities by not opting them into them. SB 595 passed the Senate and was sent to the House Committee on Public Education on May 4th. HB 1149 arrived at the Calendars Committee on May 2. Neither one has been scheduled for a floor vote. At this point, we should push both, but if you only want to push one, push SB 595 because it would not have to go back to the Senate.

SB 14 UPDATE: SB 14 (Protects children from bodily mutilation and sterilization.) We hear the vote might be postponed until as late as Friday. We will be glad to have it finally passed but we want you to know that our Speaker and the members who are left of center will use this vote to kill other bills by making them “run out of time.” This game is not new but it makes us mad.
I was in the chamber during the transgender activists’ disruption last week. I took some video but would have to edit out nudity in order to post it. Those who push this agenda work to get their “cult” members to believe that they will die if we pass a law to protect children until they are old enough to begin to understand the consequences of these procedures on their health and future in general. This creates emotions and behaviors that can be disturbing!

Secure Our Elections

SB 921 (Hughes) bans rank-choice voting for Texas. RCV has been found to be wrought with errors and often times elects a candidate who was only favored as the first choice by a handful of voters. SB 921 was voted out of the Senate 21 to 9.
SB 990 (Hall) would help us return to more transparent and personalized precinct voting.
SB 397 (Hall) co-authors Bettencourt, Parker) would memorialize the early vote totals but keep them secret until the polls close on election day

This is one of our favorite education bills this session.

SB 163 (Campbell) - The House Committee on Public Education will hear this bill on Tuesday, May 9. SB 163 will make the critical opt-in for any sex-ed training/teaching at a public school permanent. This is a parent’s rights issue and helps parents protect their children from material they know they are not ready to hear. This also helps children who don’t have good parenting. If they have no one to discuss heavy topics with at home they are much better off if they don’t get taught the topic at all.

HB 907 (Moody) will be heard in the Senate State Affairs Committee – We OPPOSE this bill. It deletes many of the judge categories which are currently allowed to perform a marriage ceremony in Texas. We believe this will make it harder for people without a faith to find a person to officiate their marriage and then allow the state to put pressure on faith leaders to fill the gap. Some pastors will not perform a marriage for those who are not actually making a covenant before God and we don’t want to give anyone fodder to try to force them to act against their sincerely held belief.

US House Republicans are addressing the crisis at the border, and they need our support. The open border policies of the Biden administration have led to unprecedented amounts of immigrants flooding into the United States. The House will vote this week to reverse the current disaster.
The Border Reinforcement Act (H.R. 2) focuses on reforming asylum and parole laws, uniting families, penalizing those here illegally, and holding employers accountable for who they hire.
H.R. 2 puts into law many Trump-era initiatives to stop the flow at the border. Previously stopped by the Biden administration, construction on the border wall would resume under this bill and requires additional barriers in certain locations. Extra funding will go to the brave men and women who are patrolling the border as well as hiring new agents to tackle the problem head-on.
While security at the border builds up, this bill will end the Biden administration’s catch-and-release program by putting back into place the “Remain in Mexico” policy which requires immigrants traveling through Mexico to seek asylum there first or remain in their home country while they await the decision from the United States. This will reduce the chances of illegal immigrants skirting court dates or abusing benefits paid for by hard-working Americans.
We have heard countless stories of sexual abuse and even murders of women and children at the hands of cartels dominating the border. H.R. 2 weakens incentives for individuals and families to work with them. Family units that are apprehended at the border for crossing illegally will be detained rather than released to cartels or inside the U.S.
While much of the focus is on securing the southern border, the nation is seeing a massive influx of visa overstays as well. They have generally enjoyed fewer penalties than those entering illegally but will now face the same consequences.
Eagle Forum joined over a dozen like-minded organizations to support the House’s efforts to bring H.R. 2 to a vote this week. We ask that you contact your Representative as well and ask them to vote YES on the Border Reinforcement Act (H.R. 2).

The left seems to be on a mission to erase women from every facet of society. They have perpetuated the lie that there are more than two sexes that have seeped into our governing bodies. The most recent Title IX proposal from the Department of Education pushes this agenda and must be stopped.
The 51-year program originally was designed to give girls and women opportunities in education and athletics. Because of differences in physical makeup and privacy needs, institutions had to provide separate male and female spaces as well as sports teams. Now, the Biden administration has flipped Title IX on its head by allowing biological males to take over the fields and locker rooms that were reserved for women.
We have already seen how unfair and dangerous it is to allow men to compete against women in athletics. Multiple situations have arisen from boys being allowed in girls’ restrooms and locker rooms. Girls have lost college-level scholarships to biological males because the competition is not fair. School administrators and coaches, whether they agree or not, are being forced to comply or lose their jobs.
Boys have dominated competitions by joining the women’s teams and even injured girls by playing. Last year, Will Thomas, who identifies as a transgender woman named Lia, placed 65th in the 500-yard freestyle swimming competition. Later that year, Thomas joined the women’s team and placed first. Earlier this year, a female high school volleyball player suffered a concussion and significant long-term effects from a biological male spiking the ball in her face. This backward agenda ignores our daughters’ health and future.
Team members and parents have spoken out against these actions. Yet, they’ve been met with hostility and even violence. When parents across the nation brought up privacy concerns to their local school boards, the Biden administration called them “terrorists.” Riley Gaines, a swimmer who competed against Lia Thomas, was assaulted and barricaded in a room at San Francisco State University for speaking out against this injustice. Proponents of this ideology have every intent to silence dissidence.

You can make your voice heard on the new Title IX regulation from the Department of Education by submitting a comment. Eagle Forum signed onto the Title IX Coalition letter asking the Department to extend the comment period but was denied this reasonable request.
Therefore, you must submit your comments before May 15th to let them know that you oppose this regulation. Please use the following talking points to formulate your own comment. The Department will ignore duplicate comments.
Talking Points to Use in Your Comment:
Title IX gives women athletes the right to equal opportunity in sports in educational institutions that receive federal funds, from elementary schools to colleges and universities.
For 50 years, young men and women have been able to access educational programs regardless of sex due to Title IX regulations. However, the new proposed rule will upend these protections, especially for young girls.
Although under this proposed regulation there are possible grounds for allowing such teams, the exceptions are overly burdensome and put the onus on schools and coaches to justify prohibiting transgender students from playing on teams that do not match their biological sex. This regulation ignores biological facts, puts female athletes at risk of injury, will lead to loss of opportunities for female athletes, and will repeal the guarantees of Title IX.
The Department of Education, in its explanation of the proposed rulemaking, admits that fairness in competition and physical safety may be reasons for all-female programs to be allowed to operate under an exemption to the regulation. The Department states that programs with the objective of communicating or codifying disapproval of a student or a student’s gender identity are not allowed. Those who are opposed to the regulation are not speaking up out of animus but because we believe that biological reality, safety, and fairness are the reasons to make distinctions based on gender identity.
The Department’s proposed regulation requires every coach and school administrator to justify why each sport at each competition level should be allowed to exclude trans-athletes if they desire to have all-female teams. This opens up each school to possible litigation if they decide to provide girls with the original protections of Title IX.
Allowing biological males to compete against females is unfair and dangerous. Multiple situations have already risen from boys being allowed in girls’ restrooms and locker rooms. Girls have lost college-level scholarships to boys because they simply cannot keep up. School administrators and coaches whether they agree or not are being forced to comply or put their job on the line.
There are numerous cases in which male athletes have ranked low in male divisions but have placed first after joining the women’s team. Meanwhile, girls are suffering from long-term concussions and other injuries due to the immense strength of biological males in competition. Title IX was meant to give girls fair and safe opportunities to compete, yet the new rule completely upends this intention.
The attack against free speech is perpetuated by this new rule. Parents across the nation have spoken out on this issue. They are deeply concerned about the safety of their daughters in private spaces out of the sight of school administrators. Yet, when they have taken this problem to their local school boards, the Biden administration called them “terrorists.” The language of this policy contains no safeguards or parental notification for changes in accommodations, breaches of privacy, or notice that their daughters will be competing against males. This opens the door to abuse and is unacceptable.
This decision would usurp our Constitutional rights to speech, religion, and state sovereignty. Currently, twenty states have passed laws that prohibit biological males from competing in female sports. However, the new Title IX rule would overturn these policies. Plus, any school whether public, private, or religious that receives federal funding will be forced to comply with the new rule. This regulation is an aggressive, overreaching attempt to force an agenda that the majority of Americans do not agree with.
This regulation will effectively erase women and girls all in the name of transgender ideology. I oppose this regulation and ask that you not move forward with finalization.

HB 900 passed the House and has been assigned to the Senate Education Committee.
This legislation by Representative Jared Patterson of District 106 is a strong bill with a mechanism to remove sexually explicit materials, a clear definition of those materials, and standards for school libraries. It includes enforcement measures for vendors who will be unable to sell to Texas schools if found in violation of the law.
In the House Public Education Committee hearing, there were 364 pages of comments from the grassroots on this legislation. This demonstrates that your emails, phone calls and public comments DO MAKE A DIFFERENCE.

SB 1584 (Hall) SUPPORT – SB 1584 has a hearing in the Senate Committee on Health and Human Services. This is a medical freedom bill. This bill would allow you to choose to receive directed blood donations if you need a transfusion. This allows people to choose to protect themselves from receiving Covid vaccinated blood.
ACTION NEEDED: Email the Senate Committee on Health and Human Services and ask them to vote SB 1584 out of committee immediately so it can get through the Senate and to the House in time to get passed.
IMPORTANT BILLS THAT STILL NEED A HEARING

HB 478 (Hull) (and/or companion bill SB 163 (Campbell, Hughes) which passed the Senate 24-7 and is also sitting in the House Committee on Public Education – SUPPORT.
This bill will make the OPT-IN for Sex-ed permanent. This protects children with parents who don’t want them to learn about sex from others and it protects children who have parents that don’t pay attention to what happens at their school. If a child has no one who will discuss heavy material with them, they are better off not hearing it at all.
ACTION NEEDED: Please email or call the House Committee on Public Education Chair, Brad Buckley, HD 54, (512) 463-0684 or brad.buckely@house.texas.gov and ask him to give HB 478 or SB 163 a hearing this week. If you live in his district, PLEASE get friends and family to call as well.
SB 330 (Hall) passed the Senate unanimously and was referred to House Committee on State Affairs on April 27. HB 1412 (Schaefer) is an identical companion bill. This is the best GRID bill by far and it passed the Senate 30-0. It is a truly non-partisan bill. It would protect Texans from natural or terrorist EMPs that could easily destroy our electrical grid.
ACTION NEEDED: Please contact the Chair of the House Committee on State Affairs, Chairman Todd Hunter, and let him know that you want SB 330 or HB 1412 to get a hearing in time for the bill to pass on the floor of the House. It is a non-partisan issue and our elected officials must make sure our state has protected the people.

3) Pray! People who somehow have believed the lie of gender being other than the sex God created us to be can become very emotional about this issue. They are teaching young people that they should be suicidal over this issue. It is an evil agenda and they have fallen for it. Pray that our side will have compassion for them and understand that they are currently blind. Pray that they will actually hear the truth as they also sit in the gallery. Pray for protection for our elected officials who are working hard to provide Texans with good policies and for those traveling to support them during the floor vote. Transactivists got very riled up at the hearings on these bills - pray that they will remain civil on Monday and Tuesday.

HB 218: We hope to STOP Texas from joining the states that are increasing drug use, homelessness, mental illness, crime, cartel activity, fentanyl overdoses, highway DUI fatalities, and more by stopping HB 218 from passing in the House tomorrow. It would still have to pass in the Senate, but we want to make sure it never even reaches the Senate.
ACTION: Please call today and ask your Representative to VOTE NO on HB 218 on Thursday, April 26. This bill would turn possession of 2 ounces of marijuana in any form into a small citation. After 180 days, those cited can pay $30 to erase all evidence of their drug possession. Then they can do it again and again and again.
Some quick facts:
Marijuana impairs. DUI fatalities double upon legalization.
About 50% of young users admit to driving knowing they were impaired.
Today’s marijuana is many times stronger than that of the 80’s and 90’s.
15% of new cases of psychosis are attributable to cannabis use.
Adolescents exposed to marijuana are 2-4 times more likely to develop a schizophrenia spectrum disorder and all ages initially diagnosed with a cannabis-induced psychosis have greater rates of developing schizophrenia over the long term. These conditions are expensive and hard to live with. They also increase homelessness.
Marijuana compounds problems with alcohol and other drugs.
Marijuana users are more than twice as likely to move on to abuse prescription opioids according to a study of 30,000 American adults.
Marijuana is known to contain toxins, chemicals, mold, and heavy metals.
This bill would be a giant step toward complete legalization. Since this bill would allow enough marijuana for 120 cigarette-sized joints or up to 2 oz. of wax, dabs, shatter, edibles, etc., people will get it from the streets. This will grow the number of drug users in Texas and they will soon call for complete legalization.
A few reasons why we do not want to legalize this drug in any form:
Since marijuana legalization in Colorado in Nov. 2012, the state has seen its crime rate increase 11 times faster than in the 30 largest cities in the US.
Court filings under the Colorado Organized Crime Control Act that were linked to a marijuana charge increased 639% from 2013-2017.
A 2019 Denver study found that neighborhoods adjacent to marijuana businesses saw 84.8% more property crime each year than communities without a shop nearby.
Big Pharma, Big Tobacco, and Big Alcohol are all becoming big marijuana investors. They don’t care how they get your money as long it is a product that you might become dependent upon.

Fellow Patriots, Parents and Grandparents,
It has come to our attention that HB 11 repeals Section 21.042 of Texas Education Code. Section 21.042 provides critical oversight to the State Board for Educator Certification (SBEC). This tiny provision was snuck into what is otherwise a fine bill that increases teacher pay.
Section 21.042 of Texas Education Code is as follows:
Sec. 21.042. APPROVAL OF RULES. The State Board for Educator Certification must submit a written copy of each rule it proposes to adopt to the State Board of Education for review. The State Board of Education may reject a proposed rule by a vote of at least two-thirds of the members of the board present and voting. If the State Board of Education fails to reject a proposal before the 90th day after the date on which it receives the proposal, the proposal takes effect as a rule of the State Board for Educator Certification as provided by Chapter 2001, Government Code. The State Board of Education may not modify a rule proposed by the State Board for Educator Certification.
By removing this section, the State Board for Educator Certification (SBEC), which is an unelected state agency, can adopt any rule they want without the oversight of the SBOE or Texas voters. Removing the SBOE’s oversight of the SBEC’s rules for Texas educators, including Texas school librarians, violates core principles of the Republican Party of Texas, including Consent of the Governed. It is also in violation of the RPT Platform Plank 119. The SBOE represents the people of Texas, including the parents of the children who attend our public schools. Removing the governing authority of the SBOE in Section 21.042 is removing the will of the parents they represent.
The importance of maintaining Section 21.042 of TX Education Code was recently demonstrated by the critical action of the SBOE.
On Friday, April 14, 2023, the SBOE rejected the SBEC’s proposed revisions to Chapter 19 of Texas Administrative Code, which includes Texas library certification. In these proposed revisions for Texas school librarians, the SBEC attempted to impose strict adherence to the “woke” ideology of the American Library Association’s Code of Ethics.
While the 88th Texas Legislature is overwhelmingly in support of prohibiting sexually explicit materials in Texas public school libraries, the ALA considers this regulation censorship, as expressed in the ALA’s Code of Ethics. This is in direct opposition to HB 900 by Rep. Jared Patterson, which was just engrossed by the Texas House in a vote of 95 to 53.
If it weren’t for the SBOE’s ability to reject proposed revisions by the SBEC, Chapter 19 of Texas Administrative Code would have been changed in a way that undermines the work of the 88th Legislature to protect Texas children from sexually explicit materials in their school libraries.
Please contact your Texas House Representative and ask for a substantive amendment to HB 11 by striking its repeal of 21.042.

MARIJUANA
HB 218 OPPOSE – On Wednesday, April 26 the entire House will vote on HB 218, which is a partial marijuana decriminalization bill (and a near legalization of 2 oz. or less, which, if it is just leaf marijuana, is 120-200 joints). Joints these days contain about 200 mg of THC, while just 10 mg of THC can set off a psychotic episode. If it is synthetic, wax, dabs, shatter, etc., it may contain much more THC.
TAKE ACTION
Please call your Representative and tell him or her that you do not want to live in an addicted world. Marijuana is a dangerous drug. It can cause mental health issues like psychosis, schizophrenia, and bipolar disorder. This bill will increase the very issues they claim they want to “solve” during session (overdose deaths, homelessness, child abuse, etc.). Marijuana users are much more likely to get addicted to heroin or synthetic opioids than non-users. We understand giving a second chance for a one-time mistake. We cannot pass a bill that is basically a ticket that is likely to get dismissed, a 180-day waiting period, and then it costs $30 to completely cleanse one’s record. It is a rinse and repeat bill. It impacts developing brains the most. No family hopes to have a member addicted to any drug. Why are we even voting on a bill that will lead to more of this?

Hearing Tomorrow - Finish Border Wall and Declare an Invasion
The battle to see the state of Texas fortify its border with a physical deterrent and declare an invasion continues as the Senate Committee on Border Security is set to hear both SB 1481 and SCR 29 by Senator Brandon Creighton tomorrow, April 20, 9 am, room E1.016 at the Texas Capitol in Austin.
SB 1481 would give the Texas Facilities Commission the power of eminent domain over real property to prevent human trafficking and illegal aliens from entering the US, among other reasons, to construct and finish Trump’s border wall.
SCR 29 invokes the state of Texas’ constitutional right to repel the invasion at the Texas border under Article I, Section 10 of the US Constitution and cites the Federal Government's failure to uphold their duty to protect states from invasion under Article IV, Section 4 of the US Constitution. It also references Section 4, Article 7 of the Texas Constitution which states the Governor is the “Commander-in-Chief of the Texas Military forces” and has the power to “repel invasions.”
A strong physical deterrent at the Texas border paired with a declaration of invasion are two of the biggest steps the legislature can take as a state in the fight against illegal immigration.

On April 6th, Biden’s Department of Education released a regulation that will erase the protections the law provides female athletes. The new Title IX rule will allow biological males to play in female sports in schools and colleges. Although twenty states have passed laws protecting these programs, the new regulation will override state sovereignty and make every school seek an accommodation in every sport at every grade level if they want to have a girls-only team. This is in direct conflict with the original raison d’etre of Title IX.
Sadly, in the last several years, some schools and colleges have already allowed males to unfairly play on female teams. Stories abound of those who have experienced this discrimination first-hand. In 2022, Riley Gaines, a competitive swimmer for the University of Kentucky, was forced to compete against biological male Lia Thomas. After placing 65th in the men’s division, Thomas stole first place in the women’s division on a national level. Gaines watched many of her teammates and women competing in other races lose the placements they deserved. She stated:
“Equal opportunity, privacy, and safety in our sports shouldn’t be controversial. The women who once advocated for Title IX should be outraged as this goes against everything they fought for. Female athletes of all ages, levels, and sports deserve better.”
Not only are trans activists erasing women through policy, but they are also becoming increasingly violent. Biology supporters like Riley Gaines are being verbally and physically attacked for simply sharing their experiences and trying to protect future athletes. Clearly, this aggressive agenda needs to be overruled by truth.
Thankfully, Congress is providing a solution. This week, House Republicans are moving legislation called the Protection of Women and Girls in Sports Act (H.R. 734). The bill harkens and re-establishes the original intent of Title IX by clarifying that any institution that receives federal funds cannot allow biological males to compete in sports that are explicitly for females.

Sen. Tuberville Holding the Line to Protect Life in the Military
One of our US Senate allies needs your support! Senator Tommy Tuberville (R-AL) is taking measures to oppose abortions funded by our tax dollars.
Shortly after the Dobbs decision, Biden and his cronies sought out means to fund abortions through the federal government. Despite explicit language in the National Defense Authorization Act to bar any federal funding of these atrocious procedures, the Biden administration announced that they would pay for military personnel to travel across state lines to terminate a pregnancy. Then, on February 16th, the Department of Defense announced that family members of military personnel could receive these services as well. These actions are unlawful and dangerous for military families.
Sen. Tuberville has exhausted all other means. In July 2022, he joined twelve of his Senate Armed Services Committee colleagues in a letter to the DOD asking questions related to the agency’s claims that taxpayer-funded abortions will increase military readiness. After not receiving a response, they followed up again at the beginning of March 2023. Additionally, he has introduced a joint resolution to nullify the policy altogether, but it has failed to gain traction due to the Democrat majority in the Senate.
Because the DOD refuses to respond or take accountability for their actions, Sen. Tuberville is now blocking Biden’s defense nominees from moving forward until the Biden administration drops this egregious policy. Our Senators who sit on the Armed Services Committee can stand alongside Sen. Tuberville and join his efforts by doing the same.

SB 52 State hospital caregiver visitations by Zaffirini - Relating to the right of state hospital patients to designate an essential caregiver for in-person visitation. Voice your support for TX SB 2 Election Integrity Bill which increases the penalty for illegal voting to a FELONY
Senator Bryan Hughes (SD 1) has submitted SB 2, increasing the criminal penalty for illegal voting to a felony, which was haphazardly removed in 2021.
First, the bill clarifies the standard for illegal voting. Second, it returns the penalty for illegal voting from a misdemeanor to a second degree felony, which was the penalty prior to 2021. Co-authors of the bill include Montgomery County Senators Bettencourt, Creighton, and Kohlkorst, alongside Flores, Huffman, King, Middleton, Parker, Paston, Springer.
Thousands of delegates to the 2022 Republican State Convention, along with Montgomery County voters, are very concerned about election integrity which was voted as the number one Legislative Priority by convention delegates. If our elections are not secure, our whole system of government is in jeopardy.
An identical companion bill has been filed in the House, HB 4198, authored by Montgomery County Representative Steve Toth and assigned to the State Affairs Committee. Last session a similar bill was debated and not passed, and Speaker Phelan seems uninterested in pushing through on this priority.

Ban Gender Modification of Children
The Tennessee Legislature passed a bill on Feb. 23 banning the practice of gender transition for minor children. Meanwhile, here in the red state of Texas, our elected officials on balance seem reluctant to take up the banner.
What could be more obviously wrong than allowing the chemical and surgical castration of children? This deceitful movement lies to our children about scientific facts and encourages them to mutilate their young bodies before they are even old enough to consent to this destruction. No one can change their God-given biological sex and we must not let the medical community experiment on innocent children.

Send a Public Comment to HHS on Stripping Religious Freedom From Medical Professionals
Once again, our medical professionals are being forced to participate in procedures that they disagree with. The Department of Health and Human Services (HHS) has issued a new rule that forces doctors, nurses, and pharmacists to participate in controversial measures such as abortions, transgender surgeries, and dispensing abortion-inducing drugs.
In 2017, Trump issued an executive order establishing the White House Faith and Opportunity Initiative which elevated the voices of faith-based groups. Those groups recommended policies that would protect religious liberty, one of which protected the conscience rights of medical professionals. The Department of Health and Human Services (HHS) eventually strengthened the ability of nurses, doctors, and pharmacists to refuse services that violate their moral beliefs. In 2018, the HHS Office of Civil Rights set up a new division to assist providers of faith in reporting civil rights violations. It was widely successful in defending the religious liberty rights of those in the medical profession. However, Biden’s HHS rule dismantles much of this progress.
Nurses shouldn’t be pressured to take the lives of preborn babies. Doctors shouldn’t be forced to provide body-altering surgery for patients with gender dysphoria that doesn’t treat the root problem. And pharmacists shouldn’t have their livelihoods threatened for choosing not to dispense drugs that not only abort lives but come at a great health risk to women.
Currently, HHS is asking for public comments regarding their proposed rule. We have prepared a template to begin your submission. We highly encourage you to use your own words and change the subject line. When HHS receives comments, they must read each one unless it is a duplicate of another letter. For your comment to be considered, it must have slightly different wording.

(AUSTIN, TX) -- Senator Bob Hall (R-Edgewood), has been sounding the alarm of the threats to the United States from weapons designed to destroy the electrical grid since first elected to office in 2015.
In 2016, Senator Hall delivered a presentation to Enterprise Forum Texas that highlighted that the risk of an attack from an adversarial country could be delivered by way of a weather balloon.
"There are several very real threats to the power grid, and the consequences would be so severe that we should address this now,” Hall said. “There are hostile countries that might cause this, but there are also natural forces that may also cause the same result soon. Either way, we need to be prepared.”
For over a decade, experts have warned that the U.S. electric grid is vulnerable to physical, cyber, and electromagnetic pulse (EMP) threats. However, unlike physical and cyber, the threat from an EMP to the nation’s electric grid has been all but ignored by the government and the electric industry.
The experts on the White House Commission on EMP concluded that one of the most likely high altitude nuclear (EMP) attacks would be delivered by a weather balloon.
“I appreciate this threat not just as an electrical engineer, but also as a former U.S. Air Force officer who led a project team to protect the Minuteman missile system from this very same threat. We also know that other nations like Israel, China, South Korea, and Russia are taking the necessary steps to protect their electrical grids,” stated Hall.

On Jan. 17, 2023, the Washington Post posted “Texas Republican National Committeewoman Toni Anne Dashiell stood by her McDaniel endorsement even after the state party voted unanimously against McDaniel.”

Ask Your US Representatives to Protect Title IX
After fifty years of Title IX protecting women’s and girls’ access to education, sports, and privacy, the Biden administration is erasing what it means to be female and turning Title IX on its head. The Department of Education decided to change the definition of ‘sex’ to include sexual orientation and gender identity. This means that biological men can play in girls’ sports teams and have access to their private spaces. Parents of minors do not have to be informed about these changes and any opposition could have severe consequences.
National Eagle Forum joined the Title IX Network to team up with like-minded groups to restore the original intent of Title IX. This Thursday, January 26th, we will meet with multiple members of Congress in Washington, D.C., to ask them to advance bills that protect girls, women, and parents from this dangerous rewriting of not only womanhood but language.

Texas House rules debate to be held today
Texas Eagle Forum President, Cindi Castilla, and fellow grassroots Conservatives are in Austin to meet with legislators.
“We are frustrated that Speaker Phelan moved away from normal protocol to schedule the vote on rules today instead of tomorrow,” said Texas Eagle Forum President, Cindi Castilla. “Win or lose today, he will see the grassroots’ strength on Thursday!”
While the vote is not always held on the same day each legislative session, the Republican Party of Texas (RPT) had announced plans for grassroots members to visit the legislative session on Thursday and be present for the rules vote.
Here's how Republican Party of Texas Chairman Matt Rinaldi described the move: “Reprehensible, but not surprising. House Republicans too often show contempt for their voting base, and they will twice [on Wednesday]. The first will be when they take the unusual step of debating House rules a day early to avoid visiting constituents; the second, when many House Republicans will vote to award powerful leadership positions to Democrats.”
Castilla has been in Austin all week with legislators discussing the Texas Eagle Forum legislative priorities and will continue that work the rest of the week.
Grassroots Republicans from across Texas will gather in Austin tomorrow to encourage legislators, and had hoped to watch the debate and the vote on rules for the 88th Texas Legislative Session.

Ask your state representative to ban committee chairs of the minority party
The Texas Legislature begins their new session on January 10. One of the first decisions they will be making will impact the rest of the session. It is very important that we get as much of your help as we can in contacting legislators.
That decision is whether to appoint Democrats to committee chairmanships. Committee chairs have the power to unilaterally kill legislation and Democratic chairs have used their power to do so. The power that comes with chairmanships also attracts lobbyist money that is used to defeat Republicans.
Republican voters support banning Democrat committee chairs
GOP voters overwhelmingly support banning Democrats from chairmanships, but most lawmakers have been unresponsive. Only five supported the ban in the last session. So far, 19 have indicated they will support the ban in this session.
GOP Speaker of the House Dade Phelan shows no interest in the ban, yet 81 percent of Republicans voted to support the ban on the March 2022 Primary Ballot.
The first order of business in the new session will be to elect the 2023 Speaker of the House and the issue of chairmanships will be decided shortly thereafter.
The Republican Party of Texas issued the following statement on Jan. 2
State legislators will be meeting NEXT WEEK to vote on adopting new chamber rules. It is a top Republican priority to ban Democrats from leadership positions.
Last session, Democrat chairs killed several GOP priority bills, including:
Business & Industry Committee Chair, Democrat Rep. Chris Turner, killed a religious freedom bill, HB 1569.
Public Education Committee Chair, Democrat Rep. Harold Dutton, killed a School Choice bill, HB 4537.
Criminal Jurisprudence Committee Chair, Democrat Rep. Nicole Collier, killed the strongest bill to protect our historic monuments, HB 446, which would have increased criminal penalties for damaging or destroying monuments.
Many other good bills were killed and bad bills advanced by Democrat Chairs, who also used their positions as a platform to push progressivism and raise lobby money to use against Republican candidates in general elections.
Here’s what we need you to do:
Step 1) Call your State Representative; a phone call is more effective than an email. If you don't know who your Representative is or their phone number, click here.
Step 2) Urge them to release a public statement (Tweet, Facebook post, mass email, or press release) supporting House Rules that ban Committee Chairs of the minority party. If they have already made a public statement banning Democrat Committee Chairs, thank them.

While Texans were making last-minute Christmas preparations, Senator John Cornyn was voting for the $1.7 trillion Omnibus Bill. The vote took place on Thurs., Dec. 22, marking another break between Senator Cornyn, Senator Ted Cruz, and other conservative senators.
Senator Cornyn joined senate Democrats and 17 other Republican senators to advance a 4,155-page spending bill that excludes funding to complete the construction of the wall on the U.S. Southern border, but includes $410 million dollars for “enhanced border security” in Jordan, Lebanon, Egypt, Tunisia, and Oman; nearly $45 billion in aid to Ukraine; dozens of earmarks for “woke” community projects; and changes to the Electoral Count Act of 1887.
Contact Senator Cornyn to express your concerns with his vote to approve the pork-filled Omnibus Bill.

Ask Your House and Senate Lawmakers to Vote Against Omnibus
Our elected officials must stop a massive $1.7 trillion spending bill that is currently moving through the House and Senate! The omnibus would fund the government through next year and avert a government shutdown this week. However, the devil is in the details. This piece of legislation is fraught with unnecessary and destructive policies. Here is some of the leftist agenda included:
$575 million goes toward “family planning” in areas where population growth “threatens biodiversity.”
A prohibition on border security funding for the USA while funding other countries’ borders.
Over three thousand earmarks totaling almost $10 BILLION.
“Congratulatory” earmarks include a building named after Rep. Nancy Pelosi (D-CA), two programs for Senator Patrick Leahy (D-VT), and a “Michelle Obama Trail.”
Ridiculous programs continue to be funded like “anti-racist training,” an LGBTQ+ museum in New York City, and services for the Deferred Action for Childhood Arrivals (DACA) program.
Promotion of gender programs in Pakistan and $200 million for a Gender Equity Fund.
Workforce development programs and supportive services for Transgender and Gender nonconforming and Intersex (TGI) immigrant women in Los Angeles.
Almost doubles H2-B immigrant visas (low-skilled workers) which opens the door for more illegal overstays.
$286 million to the Title X program which funds Planned Parenthood.
This just scratches the surface of the 4,155-page bill.
Government funding expires on December 23rd, so the House and Senate are acting quickly. Contact them now to urge them to vote “NO” on the omnibus.

Ask Speaker Phelan and your State Representative to ban Democrat committee chairs
The decision whether to ban Democrats from chairing Texas House committees will likely receive a vote in the first few days of the session via an amendment to the proposed House rules. Currently, the Speaker awards chairmanships to Democrats as well as Republicans.
Last session, despite a Republican majority, approximately 40 percent of House committees were chaired by Democrats. This must change if we are to pass meaningful legislation.
Why is this such an important issue?
Democrats in leadership have a pulpit and significant power over legislation. They control what bills are heard and what bills are voted upon.
Democrat chairs fundraise off their chairmanships and use that money to defeat Republicans during elections.
There are eight current Democrat members of the LGBT caucus who are committee chairs. If any of our bills to protect children from sexual orientation and gender ideology indoctrination end up in their committees, they will not advance.
When the Democrats broke quorum last session and fled to Washington D.C., Speaker Phelan indicated their chairmanships could not be revoked. So, if he is re-elected Speaker, he will not remove them, no matter what they do in their positions.

What can you do to encourage our representatives to vote for a rule change?
If you have not already done so, send a handwritten postcard to Speaker Phelan, asking that he not appoint Democrat committee chairs. The address is PO Box 2910, Austin, 78768. Also, send a postcard to your own Representative - it's the same address.
After you've sent a postcard, make phone calls to your own State Representative and Speaker Phelan's office, asking that they support the rule change to ban Democrat chairs. If they have already come out in favor of the rule change, thank them.
Ask your representative to make a public statement supporting the Ban Democrat Chairs Legislative Priority, such as a Tweet, a Facebook post, or saying it in a public forum.
